(REACH Regulation, Article 7)

  1. The producer or importer of articles must submit a registration dossier to the Agency for the substances contained in these articles if the following two criteria are met:
    1. The substance is present in these articles in a total quantity of more than 1 t p.a. and per producer or importer
    2. The substance is intended to be released under normal or reasonably foreseeable conditions of use
  2. Should an article contain substances subject to the authorization requirement in accordance with Annex XIV, the producer or importer must inform the Agency should the following two criteria be met:
    1. The substance is present in these articles in a total quantity of more than 1 t p.a. and per producer or importer
    2. The substance is present in these articles above a concentration of more than 0.1% weight by weight (w/w)
  3. Paragraph 2 shall not apply where the producer or importer can exclude exposure to humans or the environment during normal or reasonably foreseeable conditions of use including disposal. In such cases, the producer or importer shall supply appropriate instructions to the recipient of the article.

Each producer or importer of articles from which substances are intended to be released should therefore have these substances pre-registered should they exceed the quantity thresholds, in order to be able to exploit the transitional deadlines.
