Second-hand machinery and conversion of machinery

Apart from two exceptions, second-hand machinery does not fall within the scope of the Machinery Directive. The two exceptions are:

  • Machinery imported into the EEA for the first time must meet the requirements of the Directive even if it is second-hand; and
  • Second-hand machinery that has been subject to important changes as part of conversion measures is considered to be new. It is not always easy to judge whether a converted machine should be considered to have been subject to important changes or not.
