Second-hand machinery and conversion of machinery
Apart from two exceptions, second-hand machinery does not fall within the scope of the Machinery Directive. The two exceptions are:
- machinery imported into the EEA for the first time must meet the requirements of the Directive even if it is second-hand; and
- second-hand machinery that has been subject to important changes as part of conversion measures is considered to be new. It is not always easy to judge whether a converted machine should be considered to have been subject to important changes or not. Help can be found in DGUV Test Information Sheet No. 13, in which the content of the “Paper on the Interpretation of ‘Important Changes to Machinery’” was published.
