Proposal to create Product Safety Act (ProdSG) from Equipment and Product Safety Act (GPSG)

The Federal Ministry of Employment has prepared a draft bill revising the Equipment and Product Safety Act and sent it to affected parties for comment.

According to the Federal Ministry of Employment and Social Affairs, the following key goals are at the heart of the draft: 

  • Adapting the Equipment and Product Safety Act (GPSG) in accordance with Regulation (EC) no. 765/2008 on accreditation and market surveillance
  • Implementing Directive 2009/127/EC on machinery for pesticide application
  • Implementing parts of Directive 2009/48/EC on the safety of toys 

GS-mark

A number of new provisions have been introduced in an attempt to give greater force to the ‘safety tested’ (GS) mark. As a consequence, the Product Safety Committee must establish specifications that must be taken into consideration in the inspection process. In addition, all safety testing entities must in future publish information about abuse of the mark; DGUV Test has been doing this for a number of years, in the form of a blacklist. An appendix to the Act will set down the rules governing the format of the GS mark.
