On 29 December 2009, when application of Machinery Directive 2006/42/EC became compulsory, an updated list of the harmonised standards relating to the Directive was published in EU Official Journal C 321.
On 7/8 July 2009, the European Machinery Committee determined that manufacturers that apply DIN EN ISO 13849-1 benefit from the presumption of conformity even if the machinery product standards still refer to EN 954-1.
On 29 December 2009, the new EC Machinery Directive, 2006/42/EC, came into effect as the legal basis for placing machinery on the EEA market for the first time.
At 2009's A+A event, the Expert Committee on PPE again formed trade-fair commissions with Düsseldorf's district government, in consultation with the trade-fair centre's management. Teams comprising one representative from the district government and one from the Expert Committee visited a total of 223 exhibitors.
The BGAG's testing and certification body launched a new service in November, offering testing and certification of e-learning programs. It is aimed at vendors of electronic instruction tools.
In October, the testing and certification body of the Expert Committee on Electrical Engineering published four revised codes of rules for testing and made them available for download.
DIN EN ISO 13849-1 was first listed in the EU Official Journal in August 2008 and has given rise to a presumption of conformity since then. The presumption of conformity for DIN EN 954-1, on the other hand, expires at the end of this year. In accordance with the new Machinery Directive, 2006/42/EC, the presumption of conformity will become void as of 29 December 2009.
European standards play an important role for machinery manufacturers, enabling them to build safe and health-friendly machinery. The European Commission has published an initial list of standards relating to the new Machinery Directive in the EU Official Journal.
The "Akkreditierungsstellengesetz" (Accreditation Body Act) came into force on 6 August 2009 upon its publication in Federal Law Gazette issue no. 51.
The BG-PRÜFZERT testing and certification bodies of the Expert Committee on Surface Treatment and Metal and the Expert Committee on Personal Protective Equipment (PPE) have both published a revised code of rules for testing.
On 6 May 2009, a further amendment of the Directive on Marine Equipment was published in the EU Official Journal L 113. Application of this Directive 2009/26/EC is compulsory with effect from 6 April 2010.
Today, the H stamp for chains and chain fittings is known around the world as a symbol of safety and quality. Its success is reflected in the low accident figures. Recently, the 500th certificate was awarded.
The two testing and certification bodies of the Expert Committee on Building and the Expert Committee on Civil Engineering have merged. The new name of the testing and certification body is: Fachausschüsse Bau und Tiefbau, Prüf und Zertifizierungsstelle im BG-PRÜFZERT (Expert Committees on Building and Civil Engineering, Testing and Certification Body within BG-PRÜFZERT).
The ruling by the Landgericht Stendal (Stendal Regional Court) that advertising using the "CE-tested" label is misleading follows the opinion expressed by the Wettbewerbszentrale (Centre for Protection against Unfair Competition). The latter had taken legal action to stop a company from using the "CE-tested" label to advertise work gloves on the grounds that such advertising was misleading.
